The hammer falls on Psystar

After 17 months of litigation, the US District Court of the Northern District of California issued a permanent injuction against Psystar, banning it from selling hardware with Apple's operating system. " Defendant must bring its conduct into compliance with the injunction by midnight on December 31, 2009, at the latest ; defendant must immediately begin this process, and take the quickest path to compliance; thus, if compliance can be achieved within one hour after this order is filed, defendant shall reasonably see it done," Judge William Alsup wrote in his ruling.

Psystar is now banned from :
|
- Copying, selling, distributing or creating derivative works of Mac OS X, without authorization from Apple
- Inducing, assisting or encouraging anyone to infringe Apple's Mac OS X software
- Circumventing any technological measure that controsl access Mac OS X
- Playing any part in a product intended to circumvent Apple's methods for controlling Mac OS X
- Doing anythng to circumvent the rights held by Apple concerning Mac OS X
Despite this decision, the Psystar's Rebel EFI application has not been specifically mentionned by the US judge, saying that it was inappropriate for him to determine what Rebel EFI does. Anyway, he said Psystar's argument that it has the right to sell and distribute the software is weak, and won't hold up if tested in court. "What is certain, however, is that until such a motion is brought, Psystar will be selling Rebel EFI at its peril, and risks finding itself in contempt if its new venture falls within the scope of the injunction."
